Chief Minister and Council of Ministers
3.1 Position of the Chief Minister
The Chief Minister is the pivot of the state's constitutional machinery. Constitutional provisions:
- Article 163: There shall be a Council of Ministers to aid and advise the Governor, with the CM as head.
- Article 164: Ministers hold office during the Governor's pleasure; CoM collectively responsible to the Legislative Assembly.
- Article 166: All executive actions of the state government shall be expressed to be taken in the name of the Governor.
Functions of the CM:
- Cabinet formation: Advises the Governor on appointment/dismissal of ministers; allocates portfolios.
- Coordinator: Presides over Cabinet meetings; settles inter-ministerial disputes.
- Legislature: Leader of the House (Vidhan Sabha); decides legislative agenda.
- Link to Governor: Chief channel of communication between CM and Governor (Article 167 — CM duty to furnish information).
- Planning and finance: Chairs State Planning Board equivalent; involved in all major financial decisions.
- Chief spokesman: Represents the state in Union-state relations; attends NITI Aayog meetings.
3.2 The Council of Ministers
Size limitation: Under the 91st Constitutional Amendment Act (2003), the total number of ministers (including CM) in a state council of ministers shall not exceed 15% of total members of the Legislative Assembly, subject to a minimum of 12 ministers.
- Rajasthan Vidhan Sabha has 200 members → maximum ministers = 30.

Anti-defection: Tenth Schedule (52nd Amendment 1985) — ministers who defect their party lose their seat in the legislature.
3.3 The Cabinet Secretariat (Rajasthan)
The Cabinet Secretariat:
- Prepares agenda for Cabinet meetings
- Records minutes of Cabinet decisions
- Coordinates implementation of Cabinet decisions across departments
- Headed by the Chief Secretary (ex-officio Cabinet Secretary at the state level)
