10.1 Customary Rent

Rent under the Rajasthan Tenancy Act is primarily produce-based (batai/batai system) where a share of crop is given as rent, or cash-based (lagaan) where a fixed monetary sum is paid. The Act prioritizes:

  • Maximum rent ceiling: 1/6th of annual produce (Section 148)
  • Remission in bad years: Revenue Courts can reduce rent in drought or crop failure (Section 160)
  • Revision of rent: Not more than once every five years

10.2 Rent Recovery

  • Rent arrears are recovered as arrears of land revenue (i.e., like a government tax)
  • Distress on crops (seizure and sale of standing crops) is permitted only after court order
  • No private distraint (landlord cannot seize property without court permission)
