Relationship with Other Laws
8.1 Section 4 — Act in Addition to Other Laws
The Act is in addition to and not in derogation of:
- Section 125 CrPC / BNSS Section 144 — parents can claim maintenance under both; faster MWPSC remedy should be preferred first
- Hindu Adoptions and Maintenance Act 1956 — applicable to Hindus; MWPSC applies to all citizens irrespective of religion
- Personal laws of Muslims, Christians, Parsis — MWPSC is a secular, religion-neutral statute

8.2 Section 23 and General Contract Law
Section 23 creates a remedy faster than suing for breach of contract in a civil court. The Maintenance Tribunal can void the transfer directly — without the elderly person needing to hire a lawyer and approach a civil court.
