Relationship with Other Laws

8.1 Section 4 — Act in Addition to Other Laws

The Act is in addition to and not in derogation of:

  • Section 125 CrPC / BNSS Section 144 — parents can claim maintenance under both; faster MWPSC remedy should be preferred first
  • Hindu Adoptions and Maintenance Act 1956 — applicable to Hindus; MWPSC applies to all citizens irrespective of religion
  • Personal laws of Muslims, Christians, Parsis — MWPSC is a secular, religion-neutral statute

Key difference from Section 125 CrPC/BNSS:

Feature MWPSC 2007 Section 125 CrPC/BNSS
Forum Maintenance Tribunal (SDM) Judicial Magistrate First Class
Nature Administrative/civil Quasi-criminal
Maximum maintenance ₹10,000/month (central; states can increase) No fixed ceiling
Time limit 90–120 days No fixed limit
Appeal District Magistrate Sessions Court
Grandchildren liability Yes (if children not alive/capable) No (only immediate children)
Relatives liability Yes (if childless) No
Abandonment offence Section 24 MWPSC Not in CrPC

8.2 Section 23 and General Contract Law

Section 23 creates a remedy faster than suing for breach of contract in a civil court. The Maintenance Tribunal can void the transfer directly — without the elderly person needing to hire a lawyer and approach a civil court.
