Please read these Terms and Conditions ("Terms") carefully before using the Aspirant Academy platform. By creating an account or using any part of the platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Definitions

"User" (also "you" or "your")
Any individual who accesses, browses, or registers on the Platform, whether through a free or paid account.
"Platform"
The website located at aspirant.academy, all associated subdomains, mobile-optimised web interfaces, and any application programming interfaces (APIs) operated by Aspirant Academy.
"Services"
All features and functionalities offered through the Platform, including but not limited to MCQ practice, doubt clearing, answer evaluation, current affairs quizzes, mastery tracking, study plans, and any other educational tools provided from time to time.
"Content"
All text, questions, answers, explanations, articles, images, graphics, audio, video, software, code, user-interface design, and any other material available on or through the Platform, whether created by us, our contributors, or generated using artificial intelligence.
"Activity Data"
Data generated by or derived from your use of the Platform, including but not limited to quiz responses, accuracy rates, time spent per question, study patterns, mastery scores, session durations, feature usage frequency, and learning progression metrics.
"User Content"
Any content you submit, upload, or input to the Platform, including doubt queries, chat messages, uploaded answer papers, images, and any other material provided by you.
"Credits"
The virtual currency used on the Platform to access certain paid Services. Credits are purchased in packs and are consumed when you use credit-requiring features such as doubt clearing, answer evaluation, or other premium Services.
"Account"
Your registered profile on the Platform, created via email and password, Google OAuth, or Firebase phone OTP authentication, which provides access to personalised Services and stores your Activity Data.

2. Eligibility & Account

2.1 Age Requirement

You must be at least 13 years of age to create an account or use the Platform. If you are under 18 years of age, you may only use the Platform with the verifiable consent of a parent or legal guardian, in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA). By using the Platform, you represent and warrant that you meet these eligibility requirements.

2.2 One Account Per Person

Each individual may maintain only one account on the Platform. Creating multiple accounts to exploit free credits, circumvent restrictions, or for any other purpose is strictly prohibited and constitutes grounds for immediate termination of all associated accounts.

2.3 Credential Security

You are solely responsible for maintaining the confidentiality and security of your login credentials. You agree to immediately notify us at support@aspirant.academy of any unauthorised use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to safeguard your credentials.

2.4 Account Sharing

Sharing your account credentials with any other person is strictly prohibited. Any account found to be shared with or accessed by unauthorised individuals will be terminated immediately, without prior notice and without refund of any unused credits.

2.5 Device Limit

Your account may be actively used on a maximum of three (3) devices at any given time. Exceeding this limit may result in automatic session termination on older devices or, in cases of persistent abuse, account suspension.

3. Credits & Payments

3.1 Credit Packs

Credits are available for purchase in the following packs (prices inclusive of applicable GST):

We reserve the right to introduce, modify, or discontinue credit pack configurations at any time.

3.2 Non-Refundable, Non-Transferable

All credit purchases are final. Credits are non-refundable and non-transferable. Credits cannot be exchanged for cash, redeemed against other products, or transferred to another account, except as expressly provided in these Terms.

3.3 Credit Expiry

Purchased credits are valid for a period of one (1) year from the date of purchase. Expired credits will be automatically forfeited without notice or compensation. It is your responsibility to use your credits before their expiry date.

3.4 Price Changes

We may revise credit pricing at any time. We will provide at least thirty (30) days' advance notice of any price change via email or in-app notification. Price changes will not affect credits already purchased prior to the effective date of the change.

3.5 Taxes

All prices displayed on the Platform are inclusive of Goods and Services Tax (GST) as applicable under Indian law. You are responsible for any additional taxes or duties imposed by your jurisdiction, if any.

3.6 Payment Processing

All payments are processed securely through Razorpay, a PCI DSS-compliant third-party payment gateway. Your payment card details and financial information are transmitted directly to Razorpay and are never stored on or processed by our servers. Your use of Razorpay is subject to Razorpay's own terms of service and privacy policy.

3.7 Free Credits

New users receive five (5) complimentary credits upon account registration. These free credits are provided for evaluation purposes only, carry no monetary or cash value, are non-transferable, and may not be redeemed for cash under any circumstances.

3.8 Cooling-Off Period

In accordance with the Consumer Protection Act, 2019, you may request a refund of purchased credits within seven (7) days of purchase, provided that no credits from that particular purchase have been used in any manner. Once any credit from a purchase is consumed, the entire purchase becomes non-refundable. To request a cooling-off refund, contact support@aspirant.academy with your transaction reference number.

4. License Grant

4.1 Limited License

Subject to your compliance with these Terms, Aspirant Academy grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform and Services solely for your own private, non-commercial, educational purposes.

4.2 License Termination

This license is automatically revoked upon termination or suspension of your account, or upon any breach of these Terms. Upon revocation, you must immediately cease all use of the Platform and delete any cached or stored Content in your possession.

4.3 Restrictions

5. Intellectual Property

5.1 Platform Content

All Content on the Platform — including but not limited to MCQs, answer explanations, current affairs articles, AI-generated evaluations, study plans, mastery algorithms, user-interface design, source code, graphics, logos, and trademarks — is the exclusive intellectual property of Aspirant Academy or its licensors, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, and applicable international intellectual property treaties.

5.2 Activity Data

All Activity Data generated through your use of the Platform is owned exclusively by Aspirant Academy. This includes, without limitation, quiz responses, accuracy metrics, time-per-question data, study patterns, mastery scores, learning trajectories, and behavioural analytics. You acknowledge that this data is integral to the operation, improvement, and commercial viability of the Platform.

5.3 User Content License

By submitting, uploading, or inputting any User Content to the Platform, you grant Aspirant Academy an unconditional, irrevocable, perpetual, royalty-free, worldwide, fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content in any form, medium, or technology now known or hereafter developed, for any purpose, including but not limited to training machine learning models, improving Services, and creating educational content.

5.4 Anonymised and Aggregated Data

We may create, use, publish, and commercialise anonymised and/or aggregated data derived from Activity Data, User Content, and platform usage for any lawful purpose without restriction, including research, analytics, benchmarking, marketing, and product development. Such anonymised data shall not be subject to any privacy or data protection obligations.

6. Prohibited Conduct

You agree not to engage in, facilitate, or permit any of the following activities:

Violation of any provision of this Section 6 shall result in immediate and permanent termination of your account without prior notice and without refund of any unused credits. In addition, Aspirant Academy reserves the right to pursue all available legal remedies, including claims for damages, injunctive relief, and recovery of legal costs. You agree that monetary damages alone may be insufficient to remedy a breach of this section, and that Aspirant Academy shall be entitled to seek equitable relief, including injunctions, without the need to post a bond.

7. AI & Content Accuracy Disclaimers

7.1 AI-Generated Content

Certain features of the Platform, including doubt clearing, answer evaluation, and study plan generation, utilise artificial intelligence (AI) and large language models. You acknowledge and agree that:

7.2 MCQ & Explanations

The MCQ questions, answers, and explanations on the Platform are provided for practice and learning purposes. While we endeavour to maintain accuracy, we do not warrant that all answers and explanations are error-free. You must exercise your own judgement and verify information from official sources.

7.3 No Guarantee of Results

Aspirant Academy does not guarantee any examination result, rank, marks, selection, appointment, or professional advantage. The Platform is an educational aid, not a guarantee of success. Any decisions you make regarding your education, career, or examination preparation based on Content or Services are made entirely at your own risk and discretion.

7.4 Study Plans & Recommendations

Study plans, topic recommendations, and learning pathways generated by the Platform are AI-generated guidance. They do not constitute professional academic advice, and should not be relied upon as your sole preparation strategy.

7.5 Current Affairs

Current affairs content is curated and compiled from publicly available sources. While we strive for timeliness and accuracy, such content may not reflect the most current developments and should not be treated as a definitive or exhaustive source of information. Always cross-reference with official government publications and authoritative news sources.

7.6 Official Sources

For all critical and authoritative information regarding RAS/RPSC and other competitive examinations, you must refer to official publications of the Rajasthan Public Service Commission (RPSC), Government of Rajasthan, and other relevant government bodies.

8. Service Availability

8.1 "As Is" and "As Available"

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASPIRANT ACADEMY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

8.2 No Uptime Guarantee

We do not guarantee that the Platform will be available at all times, that access will be uninterrupted, timely, or error-free, or that defects will be corrected. Temporary unavailability may occur due to scheduled or emergency maintenance, updates, or circumstances beyond our reasonable control.

8.3 Feature Modifications

We reserve the right to modify, suspend, or discontinue any feature, functionality, or Service of the Platform at any time, with or without notice, and without liability to you. This includes the right to change credit consumption rates for any feature.

8.4 Third-Party Dependencies

The Platform relies on third-party services including but not limited to payment gateways (Razorpay), AI/LLM providers (Google Gemini), authentication services (Firebase, Google OAuth), and cloud infrastructure. We are not responsible for any service disruption, failure, degradation, or change in functionality of any third-party service, and such events shall not constitute a breach of these Terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ASPIRANT ACADEMY, ITS OWNER, EMPLOYEES, AGENTS, AND AFFILIATES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE PLATFORM, OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO ASPIRANT ACADEMY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL ASPIRANT ACADEMY, ITS OWNER, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER ASPIRANT ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, ASPIRANT ACADEMY SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY EXAMINATION RESULTS, RANKS, MARKS, SELECTION OUTCOMES, CAREER DECISIONS, ACADEMIC CHOICES, OR ANY OTHER CONSEQUENCES ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON THE PLATFORM, CONTENT, OR SERVICES. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND SHALL SURVIVE TERMINATION OF THESE TERMS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aspirant Academy, its owner (Sanjay Bhat), employees, agents, contractors, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising out of or relating to:

  1. Your use of or access to the Platform or Services;
  2. Your breach or alleged breach of any provision of these Terms;
  3. Your violation of any rights of any third party, including intellectual property rights, privacy rights, or contractual rights;
  4. Any User Content you submit, upload, or transmit through the Platform that infringes, misappropriates, or otherwise violates any third party's intellectual property or other rights;
  5. Your violation of any applicable law, regulation, rule, or order.

This indemnification obligation shall survive the termination of your account and these Terms. Aspirant Academy reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.

11. Dispute Resolution

11.1 Amicable Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Platform ("Dispute"), the parties shall first attempt to resolve the Dispute amicably. You must send a written notice describing the Dispute to the Grievance Officer (see Section 19) and allow thirty (30) days for resolution before pursuing any further action.

11.2 Binding Arbitration

If the Dispute is not resolved within the thirty (30) day amicable resolution period, either party may refer the Dispute to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted as follows:

11.3 Consumer Forum Rights

Nothing in this Section 11 shall be construed to limit or restrict your statutory right to approach the appropriate Consumer Disputes Redressal Commission (District, State, or National) under the Consumer Protection Act, 2019, as applicable. This arbitration clause is without prejudice to your rights under consumer protection laws.

11.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11.5 Jurisdiction

Subject to your consumer forum rights under Section 11.3, any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.

12. Termination

12.1 Termination for Cause

Aspirant Academy may terminate or suspend your account immediately, without prior notice, if you breach any provision of these Terms. In such event, all unused credits shall be forfeited without refund.

12.2 Termination Without Cause

Aspirant Academy may terminate your account without cause by providing thirty (30) days' written notice to your registered email address. In such event, a pro-rata refund of unused, unexpired purchased credits will be provided based on remaining credit balance at the time of termination.

12.3 Termination by User

You may terminate your account at any time by initiating account deletion through the Platform settings or by contacting support@aspirant.academy. Account deletion is permanent and irreversible. Any unused credits at the time of voluntary termination shall be forfeited without refund.

12.4 Effects of Termination

Upon termination of your account for any reason:

The following sections shall survive termination of these Terms: Section 5 (Intellectual Property), Section 9 (Limitation of Liability), Section 10 (Indemnification), Section 11 (Dispute Resolution), and Section 5.2 (Activity Data ownership). Any other provision that by its nature should survive shall also survive termination.

13. Communication Consent

13.1 Consent to Receive Communications

By creating an account on the Platform, you expressly consent to receive communications from Aspirant Academy through any or all of the following channels: email, SMS, WhatsApp, push notifications, and in-app messages. These communications may include transactional messages, service updates, security alerts, credit expiry reminders, and marketing or promotional material.

13.2 DND Override

You acknowledge and agree that this consent overrides any Do Not Disturb (DND) or National Customer Preference Register (NCPR) registration you may have activated with your telecom provider, to the extent necessary for delivering service and transactional communications.

13.3 Opt-Out

You may opt out of marketing and promotional communications at any time by using the unsubscribe mechanism provided in such communications or by contacting support@aspirant.academy. However, you may not opt out of transactional and service-related communications (including account alerts, credit balance notifications, security notices, and changes to these Terms), which are essential to the operation of your account.

14. Promotional Use

14.1 Anonymised Statistics

Aspirant Academy may use anonymised and aggregated performance statistics — including scores, rankings, improvement metrics, usage trends, and learning outcome data — for marketing, advertising, promotional materials, investor presentations, research publications, and any other commercial purpose, without requiring your consent or providing compensation.

14.2 Testimonials and Identifiable Information

Your first name and city may be used in testimonials, success stories, or promotional materials only with your explicit, separate consent obtained at the time of such use. You may withdraw such consent at any time by contacting support@aspirant.academy, and we will remove the testimonial within a reasonable period.

15. Third-Party Services

15.1 Integrations

The Platform integrates with and relies upon third-party services, including but not limited to Google (authentication and AI services), Razorpay (payment processing), and Firebase (authentication and messaging). Your use of these third-party services is subject to their respective terms of service and privacy policies.

15.2 No Responsibility

Aspirant Academy is not responsible for the terms, privacy practices, data handling, availability, performance, or service quality of any third-party service. Any issues arising from third-party services should be directed to the respective third-party provider.

15.3 External Links

The Platform may contain links to external websites and resources. These links are provided for convenience and informational purposes only. Aspirant Academy does not endorse, control, or assume any responsibility for the content, accuracy, privacy practices, or availability of any linked external site.

16. Modifications to Terms

16.1 Right to Modify

Aspirant Academy reserves the right to modify, amend, or replace these Terms at any time, at its sole discretion. The "Last updated" date at the top of this document will reflect the date of the most recent revision.

16.2 Notice of Material Changes

For material changes that significantly affect your rights or obligations, we will provide at least thirty (30) days' advance notice via email to your registered email address and/or through a prominent notice on the Platform.

16.3 Acceptance Through Continued Use

Your continued use of the Platform after the expiration of the notice period constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform before the notice period expires. In such case, any unused, unexpired purchased credits will be refunded on a pro-rata basis in accordance with Section 12.2.

17. Force Majeure

Aspirant Academy shall not be liable for any delay in performance or failure to perform any obligation under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to:

During any force majeure event, our obligations under these Terms shall be suspended for the duration of the event, and the time for performance shall be extended accordingly.

18. General Provisions

18.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitral tribunal, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

18.2 Waiver

The failure of Aspirant Academy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Aspirant Academy to be effective.

18.3 Assignment

Aspirant Academy may assign, transfer, or delegate any or all of its rights and obligations under these Terms to any third party without your consent, including in connection with a merger, acquisition, reorganisation, or sale of assets. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent.

18.4 Entire Agreement

These Terms, together with the Privacy Policy and any other policies or guidelines published on the Platform, constitute the entire agreement between you and Aspirant Academy regarding your use of the Platform, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

18.5 No Agency

Nothing in these Terms shall be construed to create any agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and Aspirant Academy.

18.6 Headings

The section headings in these Terms are for convenience of reference only and shall not affect the interpretation or construction of any provision.

19. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023, the details of the Grievance Officer are as follows:

The Grievance Officer shall acknowledge your complaint within twenty-four (24) hours of receipt and endeavour to resolve it within fifteen (15) days from the date of receipt. If you are not satisfied with the resolution, you may pursue the dispute resolution mechanisms set out in Section 11.
